Article 1: Definitions

In these terms and conditions, the following terms mean:

1.  " Consumer ":   any natural or legal person acquiring or using for a purpose that excludes any professional nature of products or services placed on the market within the meaning of the Economic Law Code (1 July 2015) on commercial practices and on information and protection the consumer;

2. " Seller ": by MIZEN sprl

3.  " Remote contract ":   any contract for goods or services concluded between a seller and a consumer in the framework of a sales or distance service system organized by the seller, which for this contract uses exclusively one or more communication techniques remote until the conclusion of the contract, including the conclusion of the contract itself.


Article 2: Information

Any consumer entering into a business relationship with the seller, whether at a distance or not, is presumed to have read these terms and conditions.


Article 3: Applicability

These conditions apply to each purchase of products or services offered by the seller, to the extent that it has not been expressly waived by the parties to these conditions, and that this derogation has not been confirmed by the sprl MIZEN

The only unilateral mention of a derogation by a consumer is not sufficient to depart from the application of the conditions.


Article 4: Offers and remote orders

The MIZEN sprl disclaims all liability in catalogs, brochures and other advertisements that may be vitiated by printing errors, calculations and imprecision of any kind and its consequences. When the MIZEN sprl receives an order, it will be effective only after written confirmation of the latter.Unless otherwise specified, MIZEN sprl is entitled to refuse orders or to make their delivery subject to certain conditions.

This refusal must be notified to the consumer within 15 days of the actual receipt of the order.

Unless otherwise agreed and mention of a period of validity in a written offer, tenders and tenders made by MIZEN are without commitment. Agreements with staff do not engage the seller. In addition, the sprl MIZEN expressly reserves the right to modify the prices, if such modification proves necessary.


Article 5: Right of withdrawal when the product is not defective

5.1.   Subject to the specific provisions set out in section 5.4, without regard to your other rights regarding defective products, you may withdraw from a purchase and return any product delivered for any reason if you are not satisfied provided you have notified us in writing within 14 days of the date of delivery of the product, that you wish to cancel your order and return the product.

Once you are in possession of the goods, you have the obligation to keep them and to take reasonable care of them. The product must be returned to us in its original state.

5.2   Once you have notified us that you wish to exercise your right of withdrawal, any amount charged by us will be refunded to you as soon as possible, and in any event, within 30 days of your withdrawal and to the extent that the product is returned to us in its original state. If the product is no longer in its original state, you should refer to section 5. 3 .

5. 3   Without prejudice to your right of withdrawal and in the case where a product is returned to us incomplete, damaged or in any other state than in its original condition and packaging, the refund of the sums debited will be reduced by the necessary costs incurred for the delivery of products in a state consistent with their original condition.

The consumer has the right to try and inspect his purchase to discover its characteristics and check its operation.   Just like he was in a physical , neither more nor less. Failing this, the seller could deduct from the amount to be refunded to the consumer the value of the depreciation of the good. More about your rights   on the CEC website Belgium .

The consumer must return these in their original packaging intact, unpacked or damaged, accompanied by any accessories, instructions for use at the following address:

A flat-rate amount of 25€ will be deducted from the refund to cover administrative and logistical costs. Any shipping costs will not be refunded.

Article 6: Delivery

The MIZEN sprl undertakes to deliver the requested products or services within 15 working days from the written confirmation of the acceptance of the order.

This period is 30 days if the order has been placed remotely. In case of delay in delivery, the consumer is obliged, within a strict period of 3 working days, to give notice to the MIZEN sprl to perform. Otherwise, it can not be held responsible for the delay.


Article 7: Price and payment

The price is expressed in euros. The price listed on the written confirmation of the order is final and includes VAT and any taxes.  
The consumer is obliged to honor the payment of his order within seven working days from the written confirmation of the receipt thereof.

In case of late payment, it will be due to the MIZEN sprl a 7% interest from the day after the end of the 7 day period.


Article 8: Product verification

On delivery, the products must be checked and if there is cause for complaint, it must be introduced as soon as possible. If the time limits laid down in the law on consumer protection are exceeded , the MIZEN sprl will in no way be held responsible for visible defects that taint the product delivered.


Article 9: Non - fulfillment of obligations

In case of non-fulfillment of the obligations incumbent on the buyer, the MIZEN sprl reserves the right to terminate the agreement entered into without prior notice, and subject to any damages. The MIZEN sprl specifies that the amounts that it will be will be immediately due and that an interest of 7% will be due in the event of late payment of the sums related to the non-performance.

In addition, in the event of late payment, damages equal to 12% of the amount due will be due, with a minimum of € 5 .


Article 10: Guarantee

As prescribed by the law on commercial practices, the MIZEN sprl guarantees   the products it offers for sale, against all   defects in design, material and workmanship over a period of two years   from the delivery. For used products, this warranty is one year. Batteries are not covered by this warranty. The seller's legal warranty does not affect the manufacturer's warranty.

Repair of lost data is never covered by the warranty.

Any claim for lack of conformity must be made in writing within 2 calendar months following the day the consumer has noticed the defect, under penalty of cancellation of his right to such a claim.

This warranty includes the repair of defective merchandise at no cost to the customer.

This warranty does not apply to parts or accessories if the failure results from abuse, external causes, ordinary maintenance or normal wear phenomena.


This guarantee is not applicable in the following cases (the list below is not exhaustive):

  •                                 in case of intervention or manipulation by a third party which is not legitimately authorized by the MIZEN sprl ;
  •                                 in the event of damage following a fire, water damage (flood) , sand or dust, lightning, accident, natural disaster;
  •                                 damage caused by misuse, improper maintenance, abnormal use or any other use not in accordance with the manufacturer's or seller's instructions;
  •                                 regarding the legal warranty for consumers / individuals: in case of damage due to commercial, professional or collective use of the product.


Defective goods must be completely empty when returned. At the express request of the customer and as far as possible, objects blocked in the defective goods will be returned to him, provided that they are mentioned on the repair order at the time of delivery or restitution of goods repaired or replaced. The MIZEN sprl is in no way responsible for the state in which the blocked objects will be returned to the customer.  

In case of damage, theft or loss of the goods delivered for repair, the possible liability of the sprl MIZEN in respect of the customer is in any event limited to the selling price of the goods.  

The MIZEN sprl can not be held responsible for the loss (partial or total) of the possibilities of use of the goods in case spare parts or specific accessories necessary for the repair of the goods could no longer be obtained from the manufacturer, independently of the others provisions.  

When repairing electronic devices, data stored in or by the goods to be repaired may be damaged or lost. The customer is solely responsible for the backup of the aforementioned data or their resettlement, to the exclusion of any liability of the MIZEN sprl . The MIZEN sprl is in no way responsible for the loss or reproduction of data stored in or by this type of electronic devices.


Article 11: Litigation

Any dispute that may arise between the parties will be subject to the jurisdiction of Brussels .
